We believe in and encourage the resolution of tax disputes at the administrative level, which, based on our experience, often provides technically sound solutions at a lower cost.
Our tax litigation practice actively represents clients in defenses against tax assessment notices, applications for special tax regimes, inquiries on the interpretation of tax legislation, claims for compensation and refunds of improperly collected fees, taxes and contributions, and in responses to audits and inspections by tax authorities.
The litigation team is also responsible for obtaining and renewing Negative Tax Clearance Certificates (federal, state and municipal), by continuously monitoring our clients’ tax compliance and proactively resolving any inconsistencies that might prevent the issuance of these certificates before they expire.
Judicial Tax Litigation
Our tax litigation practice advises clients in contentious situations before the courts, acting to minimize the tax burden or to challenge the improper imposition of taxes by federal, state, and municipal tax authorities.
We have solid experience across a wide range of courts, levels and tribunals, particularly before the Superior Court of Justice (STJ) and the Federal Supreme Court (STF).
Our professionals have extensive experience representing clients in all instances of the Brazilian judiciary, including writs of mandamus, claims for recovery of undue tax payments, annulment actions, defenses in tax enforcement proceedings, and other related proceedings.
The tax litigation team is also responsible for conducting due diligence aimed at managing tax litigation matters and extracting valuable insights for corporate financial management through a detailed case analysis.
